These Terms and Conditions (‘Terms’) govern your access to and use of our services, website, live coaching sessions, and mobile application content provided by Roshan Kumar (‘FITHIT’, ‘we’, ‘us’, or ‘our’). By accessing our website or purchasing any service package, you agree to comply with and be bound by these Terms.

 Scope of Services

FITHIT provides professional digital fitness solutions, serving as an online personal trainer and dietician platform. Our services include:

• App-Based & Custom Workout Plans:Customized exercise plans delivered via mobile apps or digital documents.
• Online Nutrition Coaching & Dietitian Consultation:Structured nutritional guidance, meal suggestions, and macro tracking customized to individual fitness goals.
• Live Coaching Sessions:Real-time virtual assessment, posture correction, and exercise guidance conducted via Zoom or Google Meet.
• Personalized Fitness Coaching for Weight Loss & Muscle Building:Specialized programs tailored for fat loss, body recomposition, muscle gain, and general metabolic health.

 Service Packages & Billing

FITHIT offers structured coaching programs on a subscription or package basis:

• Monthly Packages (1 Month Coaching)
• Quarterly Packages (3 Months Coaching)
• Yearly Packages (12 Months Coaching)

All fees must be paid in advance prior to the commencement of coaching services, live Zoom/Google Meet sessions, or delivery of custom workout and nutrition plans.

 Payment Processing

Payments are securely processed through third-party payment gateways, including Razorpay and PayPal. FITHIT does not directly store or hold your complete credit card or net banking credentials. By initiating a payment, you agree to abide by the respective payment processor’s terms of service.

 Strict No-Refund Policy

STRICT NO-REFUND POLICY: All payments made to FITHIT for monthly, quarterly, or yearly packages are strictly NON-REFUNDABLE and NON-TRANSFERABLE under any circumstances once the payment is made or services/plans have been dispatched.

Due to the custom nature of our fitness and nutrition planning, active time commitment during live coaching sessions, and immediate access to proprietary workout structures, we do not provide full or partial refunds, package transfers, or fee credits for unused periods or early cancellations.

 Eligibility & Minor Policy (Under 18 Years)

Our services are intended for adults aged 18 and older in India, the USA, and globally. Individuals under the age of 18 (minors) are permitted to enroll in FITHIT online personal trainer services ONLY with explicit, verifiable parental or legal guardian consent and oversight.

 Client Obligations & App Security

• Accurate Information: Provide truthful, complete, and accurate health history, age, and physical condition details.
• Account Security: Maintain confidentiality regarding your app login credentials, custom plan documents, and coaching materials provided by FITHIT.
• Safety & Communication: Follow instructions safely during live Zoom/Google Meet training sessions and notify the coach immediately if you experience pain or distress.

 Intellectual Property

All workout guides, nutrition frameworks, website content, software, logo, graphics, and video materials supplied by FITHIT and fithitroshan.com are the exclusive intellectual property of Roshan Kumar. Unauthorised distribution, duplication, reselling, or public sharing of these materials is strictly prohibited.

 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or FITHIT services shall be subject to the exclusive jurisdiction of the courts located in Dhanbad, Jharkhand, India.

CALIFORNIA CONSUMER PRIVACY ACT (CCPA/CPRA) DISCLOSURES

This California Privacy Notice supplements the general privacy policy of FITHIT (fithitroshan.com) and applies solely to residents of the State of California, USA (“California Consumers”), pursuant to the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA/CPRA”). Categories of Personal Information Collected

In the preceding 12 months, FITHIT has collected the following categories of personal information for online personal trainer and nutrition coaching services:

• Identifiers: Name, email address, phone number, IP address.
• Sensitive Personal Information: Age, physical measurements, health/injury history (collected strictly with affirmative consent for personalized fitness coaching for weight loss and muscle building).
• Commercial Information: Coaching package purchase history (Monthly, Quarterly, Yearly via Razorpay/PayPal).
• Internet/Network Activity: Browsing behavior on fithitroshan.com collected via Google Analytics.

 Disclosure & Sale/Sharing of Personal Information

NO SALE OR SHARING OF PERSONAL DATA: FITHIT does NOT sell your personal information for monetary consideration, nor do we share your data for cross-context behavioral advertising. We have not sold or shared personal information of California consumers in the preceding 12 months.

 Business Purposes for Data Collection

• Fulfilling online trainer for weight loss and muscle building services.
• Scheduling and conducting live Zoom/Google Meet coaching sessions.
• Processing payments and maintaining transaction records.
• Analyzing traffic and app interaction via Google Analytics.

 California Consumer Rights under CCPA/CPRA

• Right to Know & Access: You have the right to request details regarding what personal information FITHIT has collected, used, or disclosed about you.
• Right to Delete: You can request the deletion of your personal information collected by FITHIT, subject to statutory exceptions.
